Lyda Software Systems, LLC ("Company," "we," "our," or "us") is committed to protecting the privacy of individuals whose information we process in connection with our software platform and related services. This Policy applies to personal information processed by the Company in connection with our software platform, website, and related services. Our platform is provided to business clients ("Clients") who use our software to communicate with their own customers. Where we process personal information on behalf of a Client, we do so as a service provider acting under that Client's instructions.

2. Information We Process

We process personal information provided to us by our Clients in the course of their use of our platform. This may include names, phone numbers, email addresses, and other contact information associated with the Client's customers and personnel. We do not independently solicit personal information from end consumers.

We may also collect information necessary to operate and administer Client accounts, including billing and contact information provided at the time of subscription.

3. How We Use Information

Personal information is used solely to provide, operate, and support the services our Clients have engaged us to deliver. We do not sell, rent, or disclose personal information to third parties for their own marketing purposes.

4. SMS Communications

Our platform enables Clients to send SMS messages to their customers. Messages are sent on behalf of and at the direction of our Clients. Clients are responsible for obtaining all required consents from their customers prior to initiating any SMS communications. Individuals who receive SMS messages through our platform may opt out at any time by replying STOP. Opt-out requests are processed promptly and honored permanently.

We operate in compliance with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state messaging regulations in our capacity as a technology service provider.

5. Disclosure of Information

We may disclose personal information to third-party service providers engaged to assist in delivering our services, subject to appropriate confidentiality and data protection obligations. We may also disclose information as required by law, legal process, or regulatory authority, or to protect the rights, property, or safety of the Company, our Clients, or others.

We do not sell personal information.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to provide services to our Clients, and to comply with our legal obligations. Media files associated with platform services are subject to defined retention periods after which they are automatically deleted. Consent and opt-out records are retained in accordance with applicable law.

7. Security

We implement administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Client Responsibilities

Our Clients are responsible for their own compliance with applicable privacy and communications laws in connection with their use of our platform, including obtaining appropriate consents from their customers and honoring opt-out and data rights requests.

9. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will provide notice of material changes through our website or by direct communication to affected Clients. Continued use of our services following notice of changes constitutes acceptance of the revised Policy.
